Takbir al-Tashriq for a Woman, a Villager and One Praying Alone
Question
Respected Mufti, al-salamu ‘alaykum! Mawlana Ashraf ‘Ali ﵀ wrote in Bihishti Zewar (“Heavenly Ornaments”), part eleven, i.e. Bihishti Gawhar (“The Heavenly Pearl”), that takbir al-tashriq is wajib upon those who performed a fard ‘ayn prayer in a mustahabb congregation, provided that they are in a city (misr), i.e. being in a city is a condition. It follows that takbir al-tashriq after a fard ‘ayn prayer performed in a mustahabb congregation is not wajib upon villagers.
Answer
Having cited the opinion of the Imam (Abu Hanifa) and that of the Sahibayn, it is written in the margin of Bihishti Gawhar: in this matter the fatwa is on the opinion of the Sahibayn, therefore takbir al-tashriq is wajib upon villagers too. It says in al-Bahr al-Ra’iq (vol. 2, p. 166)
