Hajj by a Sarura — One Who Has Not Yet Performed His Own Hajj
Question
A person on whom Hajj was obligatory has died, or is suffering from his final illness (marad al-mawt). If he wishes to have Hajj performed for him, can he have it done through a person who has not performed any kind of Hajj before this, but on whom Hajj is not obligatory?
Answer
If Hajj became fard for him while he was healthy, and then he fell ill and could not perform the Hajj, and he also left a bequest, and moreover there is enough scope in the estate that the Hajj can be performed from one third of the property, then having Hajj performed on his behalf is necessary.
