Tamattu‘ in Hajj Badal

Question

The famous preacher Hazrat Shah Sufi Mawlana Muhammad Ruh al-Amin, the grand mufti (Mufti A‘zam) of the Jam‘iyyat al-‘Ulama of Bengal, who was a formidable and meticulous (muhaqqiq) scholar, wrote in his book Masa’il-i Hajj (Rulings on Hajj), p. 130, that if the one appointing (munib) or the executor (wasi) gives the deputy full discretion, then it is without doubt permissible for him to perform tamattu‘, and the Hajj is also discharged thereby.

Answer

Some other scholars too have adopted this position, but from the books of fiqh — Shami, al-Bahr, al-Ghunya — what appeared preponderant (rajih) to us is that which is mentioned in Mu‘allim al-Hujjaj.
