The Proxy, on Reaching Makka, Having Someone Else Perform the Hajj Badal and Performing His Own Hajj
Question
The one performing Hajj badal is poor and has not performed Hajj either. Will Hajj now become fard on him at the time of going for Hajj badal or not? Can the one performing Hajj badal, with the owner’s permission, on reaching Makka tell someone else to perform that Hajj badal and then perform his own Hajj, or not? The owner, that is, the one sending him, said only this: “I am sending you for Hajj badal for the deceased; here is the money; my father’s Hajj must be performed; now do it however you like.
Answer
If a poor man (on whom Hajj is not fard) goes for Hajj badal with another’s money, he should perform the Hajj badal on behalf of that very person; he should not, on reaching there, appoint someone else for the Hajj badal and perform his own Hajj. Hajj will not become fard on this poor man himself by reason of his having reached there for Hajj badal.
