An aqiqa share in a sacrifice and observing the seventh day
Question
Question: If someone joins in a large animal with the intention of aqiqa, will it be correct or not? For example, there are seven shares; Zayd took two shares in it for the sacrifice and one share in the same animal for aqiqa. In such a case will the aqiqa be correct or not, whether or not it falls on the seventh day after birth? Is there any kind of reprehensibility (karaha) in it?
Answer
In this case both the aqiqa and the sacrifice are valid; buying a share in a sacrificial animal with the intention of aqiqa causes no harm (and likewise in al-Durar wa-l-Ghurar and al-Khaniyya, p. 204). Observing the seventh day is merely mustahabb, just as aqiqa itself is at most mustahabb, not wajib.
