Ruling on the words “talaq I have handed over — handed over, handed over”: fatwas of Deoband and others
Question
Question: (1) Zayd said the following words to his wife: “میں نے طلاق دیا، دیا، دیا” (“I have given talaq — given, given”). How many talaqs, and of what kind, have resulted from these words? (2) Zayd's wife said: “مجھے فارغ خطی دیدو” (“Give me a written release from the marriage,” i.e. a divorce). Zayd said: “All right, you won't listen — طلاق دیدی، دیدی، دیدی” (“talaq I have handed over — handed over, handed over”). Now it is asked: how many talaqs have taken effect?
Answer
(1) The respected Hazrat Mawlana Ashraf 'Ali Thanawi ﵀ gave the ruling of three talaqs in this case (Tatimma Imdad al-Fatawa). Although the word “talaq” is mentioned once, the word accompanying it, “دیا” (“given”), mentioned three times, is a transitive verb that requires a direct object (maf'ul): just as a subject (fa'il)
