Acting on another madhhab after three talaqs
Question
Question: One day, early in the morning, over a trivial matter, Zayd said in anger to his wife Hind: “Since you keep quarrelling with me, then you — talaq, talaq, talaq” (تو تم طلاق طلاق طلاق); after “tum” (Urdu ‘you’) he did not use “ko” (the Urdu postposition ‘to’). When this matter was put before a certain Hanafi scholar as a request for a fatwa (istifta), the answer came that three talaqs had taken effect on Zayd’s wife, and that without halala she is haram for Zayd.
Answer
A major (mughallaza) divorce has taken effect. The fact that “ko” was not mentioned after the word “tum” makes no difference: [ar]وفي أنت الطلاق أو طلاق أو أنت طلاق الطلاق أو أنت طلاق طلاقا تقع واحدة رجعية، ومتى كرر لفظ الطلاق وقع الكل[/ar] “With ‘anti al-talaq’ (you are divorce), or ‘talaq’, or ‘anti talaq al-talaq’, or ‘anti talaq talaqan’, one revocable (raj‘i)
