Three talaqs by three words

Question

Question: Zayd first gave his wife one irrevocable (ba'in) talaq, and a little while later said: “میری فلانی بیوی کو ایک دو تین طلاق دیا، بائن طلاق کیا” (“To my wife so-and-so I have given talaq — one, two, three; I have made it a ba'in talaq”). May he now keep the said woman with him without tahlil (halala) or not, and how many talaqs have taken effect?

Answer

If the marriage had been consummated with the woman (she is madkhula), then in the case asked about a major (mughallaza) divorce has taken effect; now keeping her without halala is haram: [ar]الصريح يلحق الصريح والبائن، والبائن يلحق الصريح. الصريح ما لا يحتاج إلى نية، بائنًا كان الواقع به أو رجعيًّا[/ar] “An explicit (sarih)
