After Two Talaqs He Said: “Go from Here — Now I Have Left (You), Haven’t I”
Question
Hinda, the wife of Zayd, and her mother-in-law had an altercation over something. Zayd forbade his wife: “Why are you arguing without reason?” — but she did not listen. So Zayd said: “To so-and-so’s daughter — talaq, talaq” (فلاں کی لڑکی کو طلاق طلاق). After that Zayd also said twice to his wife: “Go from here — now I have left (you), haven’t I” (یہاں سے جاؤ اب تو چھوڑ دیا نا). In the stated case, which talaq has taken effect?
Answer
Answer (1) Since this word, in our Urdu idiom, has the meaning of explicit (sarih) talaq, as Mawlana ‘Abd al-Hayy Lakhnawi ﵀ has explicitly stated in Majmu‘a-yi Fatawa (“Collection of Fatwas”, vol. 1, p. 329), talaq has taken effect by this word as well, and three talaqs — a major (mughallaza) divorce — have fallen upon Hinda.
