The Difference between Revocable (Raj‘i), Irrevocable (Ba’in) and Major (Mughallaza) Talaq
Question
A husband, in the blessed month of Ramadan, in the evening, irritated by the fast, after a quarrel and an argument, said these words three times to his wife: “I have freed you”, and then, on being asked, he said the same words three times in front of a third person as well. In this case has talaq occurred or not? If talaq has occurred, of what kind is it: revocable (raj‘i), irrevocable (ba’in) or major (mughallaza)? And if the woman is pregnant, how many days will the ‘idda last?
Answer
In our custom (‘urf), a husband’s words concerning his wife, “I have freed you”, are equivalent to explicit (sarih) talaq, by which talaq takes effect even without intention, and by saying them three times the divorce becomes major (mughallaza).
