Marriage to a Foster Paternal Uncle
Question
Zayd’s wife gave birth to a son, Khalid. As soon as Khalid was born, Zayd’s wife died, and Zayd’s eldest daughter, Salma, brought up her brother Khalid by suckling him with her own milk. Now Khalid has a daughter of marriageable age. May Khalid contract her marriage (‘aqd) with the youngest son of his elder sister Salma or not?
Answer
In this case the nikah of Salma’s son with Khalid’s daughter is not permissible, because when Khalid drank Salma’s milk, Salma became his foster mother, and Salma’s son, having become Khalid’s foster brother, became the foster paternal uncle of Khalid’s daughter.
