A Maternal Aunt and Her Niece in One Marriage

Question

It has been eight years since my husband married my own niece (my sister’s daughter), who is a widow. We all used to live together. Once, when he came into the house, I observed hijab from him. Now I am extremely distressed — what should I do?

Answer

Combining a maternal aunt and her niece (sister’s daughter) in one marriage is haram. So the nikah your husband has contracted with your niece is not a Shari‘a nikah; rather, it is zina under the name of nikah — unlawful fornication. Your own nikah, however, has not been annulled. You should not observe hijab from your husband.
