If a fundraiser and the administrator disagree, an arbiter should be appointed
Question
A certain gentleman was employed at the madrasa, and the following was agreed with him. (1) Fundraising (travelling for donations); (2) while residing at the madrasa, the work of teaching and instruction. Remuneration: eighty rupees. Increment: five rupees monthly; increments stop at one hundred rupees. One month’s leave a year, with travel expenses there and back. But he committed the following violations. (1) Once, without permission, merely giving notice, he locked up the madrasa and left. (2)
Answer
This is a contentious case. The better way is that the fundraiser should put his statement in writing, and both parties, after consulting together, should accept someone as arbiter (hakam) and agree to his decision. Otherwise, writing a ruling on a one-sided statement will not end the dispute; the other party will declare the questioner to be in the wrong.
