Salary for the Madrasa’s Long Vacation When the Teacher Left for Another Place at Its End
Question
(1) Zayd was employed at an institution as a teacher of Arabic and was permanent. In Jumada al-Ula, through intrigue, he negotiated employment elsewhere and had himself appointed there in blessed Ramadan. In Sha‘ban he went on leave, and after Ramadan he went to the new place. He took the salary for Sha‘ban and Ramadan by deception. Whereas the rule of this institution is that one must resign at least one month beforehand and also work during that month, so that the institution can arrange another teacher.
Answer
(1) If at the time of employment nothing was settled regarding the vacation, then one should act according to the practice (ta‘amul) prevailing in other madrasas. That is: in the month of Sha‘ban, on completion of the annual examination, the vacation begins; the whole of the blessed month of Ramadan passes in vacation; then some time of Shawwal is also counted in the vacation.
