Is sacrifice obligatory if unlawful wealth is in one’s ownership?
Question
Question: If, during the days of sacrifice (ayyam al-nahr), so much wealth comes into a person’s ownership that the sacrifice becomes wajib on it — even if by an unlawful (haram) way — will the sacrifice be wajib upon him? Is the ruling the same for the haram and the halal in financial obligations (waza’if maliyya)?
Answer
If the wealth came by such a way that ownership is not established at all, as with theft, then the sacrifice will not be wajib upon him. If it came by such a way that ownership is established, as with invalid (fasid) sales, then the sacrifice will become wajib.
