Exempting a particular place from talaq does not cancel a talaq that has occurred
Question
Question: I gave my wife talaq on this condition: “سوائے شہاب پور کے طلاق دی، طلاق دی، اگر شہاب پور میں آئی تو میری طلاق نہیں ہے” (“Except for Shahabpur — I gave talaq, I gave talaq; if she comes to Shahabpur, then there is no talaq from me”). That woman came the next day and says, “In every circumstance I will stay right here.” Has talaq taken effect in this case or not?
Answer
At the moment when the husband said, “سوائے شہاب پور کے طلاق دی طلاق دی طلاق دی، اگر شہاب پور میں آئی تو میری طلاق نہیں” (“Except for Shahabpur — I gave talaq, I gave talaq, I gave talaq; if she comes to Shahabpur, then there is no talaq from me”), the wife was not in Shahabpur; therefore a major (mughallaza) divorce took effect on her.
