Pronouncing talaq by the name under which the wife is known
Question
Question: In a state of anger I gave talaq to my wife by nikah, Wahid al-Nisa, by saying this sentence: “عبدل کی لڑکی میرا نام کو میں نے طلاق دیا” (“To Abdul’s daughter named Mira I have given talaq”); I said it three times. Ten minutes later, in the same anger, I again said this same sentence three times. At the time of the marriage the qadi performed the nikah naming her “Wahid al-Nisa walad Abdul” (i.e. child of Abdul)
Answer
Since she is known among you by the name Mira and it was by this very name that you gave three talaqs, a major (mughallaza) divorce has without doubt taken place. Now, without halala, maintaining a marital relationship is haram.
