Major (mughallaza) divorce

Question

Question: [ar]ما قولكم رحمكم الله وكثّر جمعكم[/ar] “What do you say — may Allah have mercy on you and increase your gathering”: in a case where, for example, in Zayd’s presence his wife and his mother had a dispute over some household matter, and despite Zayd’s forbidding them they did not desist from the altercation. Zayd left the place, went to his father, informed him of what had happened, and stated that his mother was the one who had transgressed and was at fault.

Answer

In the case asked about, judicially (qada’an) three talaqs have taken effect, and the divorce has become major (mughallaza): [ar]كرّر لفظ الطلاق وقع الكل، وإن نوى التأكيد دُيِّن[/ar] “If he repeated the word of talaq, all of them take effect; and if he intended emphasis, he is believed religiously” (“al-Durr al-Mukhtar”, vol. 2, p. 71).
