The second husband cancels talaqs fewer than three
Question
Question: Zayd gave his wife Zaynab one irrevocable (ba’in) talaq. A few days later he contracted nikah with her again and took her back into marriage. Then, a year later, Zayd gave the said wife two talaqs and made her a divorcee. The question now is: is a renewed nikah valid without halala or not?
Answer
If three talaqs have been given — whether in one sitting or separately, and whether within one marriage contract or after contracting again (before marriage to a second husband) — then a renewed nikah without halala is no longer permitted. However, if after one ba’in talaq she marries another man, receives talaq from him after consummation (ba‘d al-dukhul)
