The fatwa follows the view of Imam Abu Hanifa
Question
Imam Abu Hanifa and the Sahibayn (Imam Abu Yusuf and Imam Muhammad) differ on this issue. On whose view is the fatwa? [ar]لو صلى فرضا ذاكرا أن عليه فائتة قبله فسد فرضه فسادا موقوفا عند أبي حنيفة ﵀[/ar] “If he prays a fard while remembering that a missed prayer is due from him before it, his fard becomes fasid (invalid) with a suspended invalidity (fasad mawquf) according to Imam Abu Hanifa ﵀…” What is the view of the Sahibayn on this issue?
Answer
Imam Abu Hanifa’s view is based on istihsan and the view of the Sahibayn on qiyas, as [stated] in “al-Qunya”, p. 494, “al-Bahr”, p. 88, and “al-Majma‘”, p. 140. [ar]والأول أرجح من الثاني إلا فيما استثني[/ar] “And the first is preferable to the second, except in what has been made an exception” — thus in “Sharh ‘Uqud Rasm al-Mufti”.
