Concerning the masbuq and the lahiq
Question
The method by which a resident (muqim) muqtadi who is a masbuq completes the remainder of his prayer is set out in the books of fiqh as follows: he performs the first two rak‘as without recitation (qira’a) and then one rak‘a with recitation; and this order is based on its being wajib, as stated in “Sharh al-Munya”: [ar]وهذا على سبيل الوجوب، ولو عكس صح وأثم على الترتيب[/ar] “This is by way of obligation (wujub); if he reverses it, [the prayer] is valid, but he has sinned with respect to the order.
Answer
(1) From the original wording of the books of fiqh, the order in the remainder of the prayer of the masbuq-lahiq is understood to be wajib. However, what Hazrat Thanawi ﵀ ruled in “Imdad al-Fatawa” by way of deduction (istinbat) — that it is mustahabb, on account of the widespread nature [of the problem] and the spread of ignorance — is both broader and gentler for [our] time.
