Nikah with the Father’s Cousin — the Son of His Paternal Aunt

Question

The girl’s father and the young man are cousins to each other — sons of a maternal uncle and a paternal aunt. The one with whom the nikah is being contracted counts as her “uncle”. Is this nikah of the girl permissible or not? Moreover, the nikah was performed in the absence of the mother and father.

Answer

Nikah with the daughter of a cousin — the son of one’s paternal aunt — is permissible according to the Shari‘a, whereas with a real paternal uncle it is impermissible. However, this man is not her real paternal uncle; rather, he is her father’s cousin — the son of his paternal aunt.
