Marriage between the Children of Two Wives
Question
Zayd has two wives. From the first wife a daughter was born; after her death Zayd contracted a second marriage, from which two sons were born. Bakr, a full brother of the second wife, married the daughter of the first wife. Is this marriage valid according to the Shari‘a? Also, may the male offspring of the second wife marry the female offspring of the first wife or not? Kindly favour us with a reasoned answer.
Answer
The marriage that Bakr, the full brother of the second wife, contracted with the daughter of Zayd’s first wife is valid according to the Shari‘a. It gives rise neither to prohibition by affinity (musahara) nor to prohibition by lineage. If there is some prohibition by suckling (rada‘a), that is another matter.
