A Nikah Contracted through a Qadiani Agent

Question

A certain person belongs to the Ahl al-Sunna wa-l-Jama‘a; he also contracted his daughter’s nikah within the Ahl al-Sunna wa-l-Jama‘a, but he appointed a Qadiani as the agent (wakil) for his daughter’s nikah. What needs to be ascertained is: is the agency of this Qadiani in the nikah valid or not? In the second case [if it is not], is the nikah valid or not?

Answer

If the girl was a minor and her father was present in the assembly of the contract, and in his presence the Qadiani conducted the offer and acceptance, then the father himself will be deemed the contracting party, the agency of the Qadiani is of no effect, and the nikah is valid.
