A Qadiani’s Waqf for a Mosque
Question
On a plan the property of a mosque is shown: it contains eight shops, marked with eight numbers. In the middle is the gate of this mosque. In front of the shops there is a piece of land belonging to a gentleman who is a son of the Qadiani religion (that is, born into it) and is himself a staunch follower of the Qadiani religion. That gentleman makes this very land a waqf for this mosque. Is this waqf of the Qadiani gentleman permissible for our mosque or for the mosque’s property, or not?
Answer
A Muslim who abandons his original religion, Islam, and becomes a Qadiani leaves Islam and is declared an apostate (murtadd); no act of worship of an apostate is accepted. Imam Muhammad ﵀ says: in those matters in which a waqf is valid according to the sect he has joined, his waqf is valid. Accordingly, his waqf for a mosque is also valid.
