The rector dismissed a teacher, then the patron reinstated him: who must pay the salary for the period of dismissal?
Question
When a complaint about a teacher of an Islamic madrasa was heard, the rector of the madrasa, after an investigation of his own whose result he considered correct, dismissed the said teacher from the madrasa’s service on the advice of a few members of the madrasa. After the dismissal the said teacher went to his hometown.
Answer
If the rector had the authority to dismiss, and he dismissed after proof to the extent of his own judgement, then the salary for those days is not upon the rector; rather, it is better that the patron give it from his own means. If the rector did not have the authority without the patron’s permission, then the responsibility lies with the rector.
