Getting a madrasa house vacated by a tenant
Question
A Muslim barber let his house on rent to another man. The tenant installed a flour mill in it. After some time the owner tried to have it vacated, but the tenant did not vacate. The owner gave half of the house to Madrasa Islamiya and made the remaining half a waqf for the repair of the Eidgah (open ground for the Eid prayer).
Answer
The madrasa room should be vacated from this mill-owner and let to someone else. Legal recourse should be taken for this. If the madrasa people see fit, they may serve the present tenant a notice to vacate, since it is needed for the madrasa, and legally in such a case he will be compelled to vacate.
