The drainpipe of the Shahi Mosque onto the roof of Madrasa Imdadiya, Moradabad

Question

(1) On the northern side of the Shahi Mosque in Moradabad, part of the roof is lower than the central roof of the mosque. The drainpipe of this part discharged northwards into Madrasa Imdadiya. Now the people of Madrasa Imdadiya have blocked this drainpipe, and there is no other outlet for its water, as a result of which rainwater collects on this part of the mosque roof and is damaging the mosque wall, and there is now a fear that the wall will collapse. (2)

Answer

(1) If this drainpipe has existed since old times and has not been newly made, it should be kept running as before; according to the position on which the fatwa is given (mufta bihi), they have no right to obstruct or block it.
