Selling the Mosque’s Timber and the Like to Spend on Its Needs, and Praying in Such a Mosque

Question

(1) If someone, without the permission of those who pray there, sells the useless items of an old mosque, such as tin or wood and the like, and has new repairs done with that money, is this permissible or not? (2) If the site of the mosque is not waqf, is prayer in that mosque permissible or not?

Answer

(1) Not everyone has the right to this kind of disposal. It is correct for the mutawalli (trustee) to do so in consultation with those who pray there, keeping in view the interests of the mosque. And as long as those items are of use to the mosque, they should not be sold. (2) If the owner of the land consents, prayer there will be valid without any dislike (karaha)
