Ruling on an oath by talaq about being unfaithful to a beloved
Question
The case is this: a man loves someone, and in an excess of love he swears an oath by talaq: “I will never be unfaithful to you; and if I am, then whenever I make a nikah, my wife is divorced (talaq).” Now if, owing to some constraint, his beloved becomes displeased with him, while this man who swore always remains well disposed towards him and, as before, is ready to do him good, yet the beloved stays displeased with him — will talaq take effect or not?
Answer
If the one who swore does not commit unfaithfulness, even though his beloved is displeased, then talaq will not fall upon his wife when he makes a nikah.
