Nikah through a fuduli, the kullama oath, and clarification of a ruling in Bihishti Zewar
Question
Naming the girl to whom I have been engaged, I said: “To Aliya, after nikah, three talaqs.” I did not say these words deliberately; I just said them in conversation, because I was not aware of the rulings concerning it. At this a certain gentleman told me that as soon as you contract the nikah, all three talaqs will fall. After that I looked at Bihishti Zewar (“Heavenly Ornaments”)
Answer
First, you made a mistake out of ignorance of the rulings, which is why you were dejected with worry; then, when your mother was consoling you, you had already become aware of the ruling by seeing it in Bihishti Zewar — and what you answered her in anger was a mistake greater than the first.
