Talaq by the Words “The Nikah with Us Has Broken”
Question
Question: What happened is this: I, my husband’s elder brother’s wife and both sisters-in-law had gone somewhere to sit; my mother-in-law was at home, and we had gone after asking her. When my husband’s elder brother and my husband came home from the shop to fetch some goods and so on, they asked: “Where have these gone?” My mother-in-law replied: “They have gone to sit at such-and-such a place.
Answer
The first and second talaqs are quite evident, because (there) the explicit (sarih) word is talaq. However, the third time he said these words: «ہمارے ساتھ نکاح ٹوٹ گیا» (“the nikah with us has broken”). This is not an explicit word but an allusive (kinaya) one.
