Talaq by the Words “Do It Where Your Daughters Are Valued”
Question
Question: A husband wrote in a letter to his father-in-law: “Your daughters will not be valued at all in Khanpur. I did not know that you are such a bad man. Hanif will not come to Gesurpur. The relationship was only for so many days; I am completely fed up with Gesurpur.” In another letter he wrote: «اب جہاں آپ کی لڑکیوں کی قدر ہو وہاں کرو، آپ کی لڑکیوں کی یہاں پر قدر نہیں ہوگی» (“Now do it where your daughters are valued; your daughters will not be valued here”). In our biradari (a kinship or caste community)
Answer
If the meaning of the last sentence «اب جہاں آپ کی لڑکیوں کی قدر ہو وہاں کرو» (“Now do it where your daughters are valued”) is that you should contract their nikah where they are valued, and he wrote this sentence with the intention of talaq, then one talaq will occur by it. If both parties agree, they may contract nikah again; there is no need for halala.
