Talaq by the Words “From My Side It Is Completely Over”
Question
Question: In front of four Muslims and one policeman Zayd said: “I do not want to keep my wife, and «میری طرف سے بالکل ختم ہے» (“from my side it is completely over”).” One of those four asked: “So has talaq taken place from your side?” To this Zayd kept silent. The policeman said: “Have you completely finished it from your side?” At these words Zayd nodded his head in the affirmative. He was then asked: “Is there still some room in this?” Then Zayd said: “There is no room.
Answer
Zayd should be asked: if he says, “I did not end the bond of nikah,” his word will be accepted. Apparently it seems that he has stopped contact and association, and has not given talaq; that is why, when he was asked about talaq, he kept silent and did not admit to talaq.
