Talaq by the words “There is no tie between me and you”

Question

Hinda’s husband beat her, turned her out of the house and said: “میرا تیرا کوئی رشتہ نہیں ہے، تیری مرضی آئے سو کر” (“There is no tie between me and you; do whatever you please”). Is it now valid for Hinda to marry elsewhere or not?

Answer

If the husband said “میرا تیرا کوئی رشتہ نہیں، تیری مرضی آئے سو کر” (“There is no tie between me and you; do whatever you please”) with the intention of talaq, then an irrevocable (ba’in) talaq has taken effect by it. After that, having passed the ‘idda of three menstrual periods, it is permissible for the woman to marry elsewhere.
