Living together without halala after three talaqs
Question
Question: A certain man is unemployed and idle, and has a family to support; his wife too gets by in straitened circumstances on day labour. Because of worthlessness there is no getting along between them. Because he himself is ignorant and obstinate, and because of the incitement of his brother’s wife, quarrels have occurred many times, and once or twice he has given three talaqs in anger, yet he still lives with her.
Answer
If he gave talaq three times in explicit words — even if he gave it at his sister-in-law’s urging — then a major (mughallaza) divorce has taken effect. Now living together without halala is not permissible. The wife should, after passing three menstrual periods from the time of the talaq, marry another man in the proper manner.
