Staying in the husband’s house after three talaqs
Question
Question: Our younger brother gave his wife three talaqs. At the time he gave the talaq, his eldest son, aged 20, and his sister-in-law were present; besides them there were seven children in the house: one elder daughter aged 17, a second daughter aged 16, a third daughter aged 12, a fourth — a son aged 10, a fifth — a daughter aged 5, and one small son aged 3. Now this woman does not want to leave the house; for two years she has been with our brother, and he bears the children’s expenses himself.
Answer
By the giving of three talaqs the nikah has ended completely; this woman is no longer his wife but has become a stranger (ajnabiyya). Now for the two of them to live in one place, and to talk unveiled, informally and in private, is no longer permissible. Without halala there is no room for a renewed nikah either.
