Talaq by the word “talakh” (تلاخ)
Question
Zayd wrote a note to his wife and wrote in it: “میں تم کو تلاخ دے چکا” (“I have already given you ‘talakh’”; ‘talakh’ is a corrupted pronunciation of ‘talaq’) — with the letters ta and kha (بالتاء والخاء) — and this word is written in several places. Now the question arises: has talaq taken effect or not? And if it has, which talaq will it be — revocable (raj‘i), irrevocable (ba’in) or major (mughallaza)?
Answer
If the husband wrote such a note and sent it to his wife, and he admits that it is his writing, or there is Shar‘i testimony to that effect, and in it the talaq (“talakh”) occurs three times, then without doubt a major (mughallaza) divorce has taken effect: explicit (sarih) words do not require intention (niyya).
