The Name Was Changed While the Nikah Was Being Performed
Question
I was married a few months ago. My wife’s real name is Kawthar Husayn, but at the time of the consent (iqrar) during the nikah, the consent was taken under the name Qaysar Jahan. The respected qadi, using the name Qaysar Jahan itself, took my consent three times, and the receipt also has the name Qaysar Jahan. I am in mental distress as to whether this nikah took place or whether there is some defect in it. What should I do from the point of view of the Shari‘a?
Answer
If her real name was Qaysar Jahan, but because it was not pronounced correctly people began calling her Kawthar Husayn; or her real name was Kawthar Husayn and people began calling her Qaysar Jahan; or both are her names — some call her Kawthar Husayn and some Qaysar Jahan — then in all these cases the nikah is valid.
