Two Sisters Married to Two Brothers, and a Mix-up at the Send-off of the Brides
Question
The marriage contract (‘aqd) of two sisters was concluded with two brothers, and at the same time, and the mistake occurred that the girl married to one young man stayed with the other young man and relations of husband and wife took place between them, and the other girl had relations of husband and wife with the other young man. In the morning it became known that the girls whose ‘aqd had been concluded with particular young men had been swapped by mistake. Please explain the ruling of the Shari‘a on this matter.
Answer
The better way to rectify this mistake is this: let each one be made to receive a talaq from the one with whom her ‘aqd was concluded, and let each forgive her mahr. Then, whichever girl reached whichever man by mistake, and with whom relations also took place under the misapprehension, let her ‘aqd be concluded with him.
