Nikah in which a friend put the thumbprint in the register
Question
A girl’s nikah was being performed. At the time of the nikah permission was not taken from the girl; rather, her mother gave permission, and in the register (the record book of marriages) too it was her friend who put the thumbprint. The girl, however, was willing, and she was also of age. In this situation, did the nikah take place or not?
Answer
If the girl approved it after the contract (‘aqd) — by word or by deed — then this nikah became valid. The friend’s thumbprint is of no consequence, since the offer and acceptance (ijab and qabul) were not carried out through her.
