The Nikah of a Young Man Who Speaks Little
Question
(1) A certain person is taciturn and answers “yes” and “no” by gesture. If at the wedding he said “yes” by gesture and did not make the ijab and qabul orally, will his nikah take place or not? (2) Can parents themselves perform (recite) the nikah of their son and daughter or not?
Answer
(1) Since he is capable of speaking — he speaks and converses as he sees fit — it is necessary for him, after the ijab of the nikah, to accept with his tongue. The ruling should be explained to him: without accepting with the tongue the nikah will not be complete; therefore after the ijab he should say with his tongue, “I have accepted.
