The Bride Gave No Consent to the Nikah, Yet Departed to Her Husband and Then Fled

Question

(1) Zayd’s marriage to Salma took place on 6 June 1979. After two weeks she went to her parents’ home, returned after a month, stayed a week and then went to her parents’ home again. After much searching and inquiry it came to light that Salma has had an illicit relationship of long standing with her paternal cousin.

Answer

(1) Since after the ijab and qabul the girl did not reject it and, according to custom, departed to her husband’s house, have no doubt about this nikah: this nikah has become valid, even if she is not pleased with it. (2) She is entitled to the mahr. (3)
