The Jumu'a prayer in a mosque that is not waqf
Question
Here there are some mosques for which rent is collected from the mosque committee: their land is not waqf. Alongside this, there are two mosques here that are waqf and have the status of a mosque in the Shari'a sense. Now the question is: in the mosques that are not waqf, will the Jumu'a prayer be valid or not, and will the reward of [praying in] a mosque be gained or not? And is i'tikaf valid in them or not?
Answer
A mosque in the Shari'a sense (masjid shar'i) comes into being only when it is waqf. Without waqf it is not a mosque in the Shari'a sense, although the Jumu'a prayer and the five daily prayers are fulfilled there too when prayed in it; but superiority (fadila) belongs to the waqf mosque, and i'tikaf should be performed only in a waqf mosque.
