By what means is zina proven?

Question

Question: (1) In connection with these same two issues, is it makruh to make the said Zamir imam or not? The prayer of the two Eids, the adhan, the takbir, the funeral prayer — is all of this makruh or not? (2) With what kind of proof does prayer behind fornicators become impermissible? (3) Whatever kind of matter it may be, if the matter is without proof, should the matter be investigated according to the Shari‘a by making the defendant (mudda‘a ‘alayh) swear an oath, placing the Qur’an in his hands? Or (if)

Answer

(1) It is not right to call Zamir a fornicator and an offender merely on the word of some woman; his adhan, imamate, funeral prayer and so on are all valid. (2) If there are witnesses to the zina, or he himself admits to zina, then his imamate will be makruh until he makes sincere repentance. (3)
