Plotting the death of one who insists on zina with his daughter
Question
Question: Zayd wants to commit forcible zina (zina bi’l-jabr) with his own daughter, and both his daughter and his wife are absolutely unwilling, because of which he beats his wife and daughter all the time. Now Zayd’s wife, being utterly worn out by her depraved husband, wants him to die somehow, so that she may be rid of this kind of disgrace and of a major sin. So, is it permissible for his wife, in order to kill this husband, to devise some means of his death or of her own death?
Answer
The wife is permitted neither to take poison herself nor to give poison to this vile husband. Rather, it is necessary to keep the daughter separate from the husband, so that he cannot get hold of her. The best way to do this is to have her nikah contracted within the family with the girl’s consent, even if the father does not agree.
