Killing one’s wife on seeing her commit zina

Question

Question: If a man saw his wife committing zina and, in anger, killed the fornicating man and the wife, will diya (blood money) be due in this case or not?

Answer

If the law of Islam is in force, diya will not be due in such a situation: [ar]ويكون التعزير بالقتل كمن وجد رجلًا مع امرأة، إلى قوله: ولو كان مع امرأته ويزني بها أو مع محرمه وهما مطاوعان قتلهما جميعًا[/ar] “Ta‘zir (discretionary punishment) may be by killing — as with one who finds a man with a woman… (up to his words:)
