Disinheriting disobedient children

Question

Question: Male children aged 14/16 years, intelligent and sensible, educated and receiving schooling in Urdu and English, who — even though their father has caused them no harm and has not mistreated them — under the incitement of their mother are so averse to him that they never even mention his name, and on hearing his name they curse; they never ask whether he has died or is alive; they fear his very shadow. Now, can such unworthy children be heirs of the father?

Answer

This unworthiness of the children is certainly blameworthy and an offence, but it does not make them deprived of inheritance, nor does the father have the right to deprive them. Even if the father said, or even wrote: “I have deprived my children; let them not be given any share from my estate (tarika),” it is still futile: they will certainly receive their Shariʿa share.
