Insistence on a Mustahabb Act
Question
Concerning the reprehensibility of iltizam (making binding what is not binding), reference was made to the statement of ‘Allama al-Tibi: [ar]مَنْ أَصَرَّ عَلَى أَمْرٍ مَنْدُوبٍ وَجَعَلَ عَزْمًا وَلَمْ يَعْمَلْ بِالرُّخْصَةِ[/ar] “Whoever insists on a mandub (recommended) matter, makes it a resolute obligation (‘azm) and does not act upon the rukhsa (concession).
Answer
Constancy (mudawama) upon a mustahabb act — while believing that leaving it is permissible — does not entail reprehensibility; it is insistence (israr) that entails reprehensibility. (The difference between constancy and insistence is not hidden from anyone who has even the slightest practice in fiqh.)
