Building a Shop for a Tenant on Mosque Land
Question
There is a place belonging to a mosque. If some other person builds a shop on it and wishes to pay the mosque a fixed sum annually, and after the sum has been recovered the shop becomes the mosque's — is this correct or not?
Answer
It should be arranged in this way: the mosque's land is let to this person on rent, the rent is taken in advance, and a shop is built with it; when the shop is complete, it is handed over to the tenant. In this way the shop will belong to the mosque, and the tenant will have the right to use it for the period for which he has paid rent in advance.
